Service Agreement and Terms of Trade

The short answer

The Pivot Trade Services terms of trade apply once a quote is accepted, a deposit is paid, or services are requested. Quotes are valid for 30 days. Work is carried out in accordance with Australian Standards, with a 12-month workmanship guarantee and manufacturer warranties on materials. Cancellations require 24 hours notice. Liability is limited to the amount paid for the relevant service, and nothing limits rights under the Australian Consumer Law.

1. Definitions

"Client", "you" and "your" refer to the customer engaging Pivot Trade Services. "Services" means electrical, solar, battery, hot water, heating and cooling installation, maintenance or related work carried out by Pivot Trade Services. "Agreement" means these Terms of Trade and any associated quotation, invoice or work order.

2. Acceptance of terms

By accepting a quote, paying a deposit, or requesting our services, you agree to be bound by this Agreement.

3. Quotes and estimates

All quotes are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on information provided by the client and on what was visible at the time of inspection. Additional charges may apply if site conditions differ materially from those described or from what could reasonably be seen.

4. Booking and deposits

We may require a deposit before commencing work. Deposits are non-refundable once materials are ordered or scheduling has been confirmed.

5. Payment terms

Full payment is required upon completion of the job unless otherwise agreed in writing. Accepted payment methods will be advised on your invoice. Late payments may incur administrative fees or interest at our discretion.

6. Cancellations and rescheduling

If you need to cancel or reschedule a booking, please provide at least 24 hours notice. Late cancellations may incur a call-out or rebooking fee.

7. Workmanship and warranties

All work is carried out in accordance with Australian Standards and relevant industry regulations, and prescribed electrical work is certified with a Certificate of Electrical Safety issued under our REC licence.

We guarantee our workmanship for 12 months from completion unless otherwise specified. Manufacturer warranties apply to all materials and products used.

8. Australian Consumer Law

Nothing in this Agreement limits your rights under the Australian Consumer Law (ACL). If our services fail to meet a consumer guarantee, you are entitled to a remedy as outlined under the ACL.

9. Access to site

You agree to provide safe and reasonable access to the property where services are to be performed. We reserve the right to postpone or cancel work if unsafe conditions are identified, including unsafe roof access, asbestos disturbance risk, or aggressive animals.

10. Limitation of liability

To the fullest extent permitted by law, Pivot Trade Services is not liable for any indirect or consequential loss or damage arising from the performance of our services. Our total liability is limited to the amount paid by the client for the relevant service.

11. Variations

Any variations to the agreed scope of work must be approved in writing. Additional work or materials outside the original quote will be charged accordingly.

12. Governing law

This Agreement is governed by the laws of Victoria, Australia, and both parties submit to the jurisdiction of its courts.
